On October 14, the auction for Lot 1 of the Suceava-Pașcani section of the A7 highway was resumed, meaning that the procedures can continue
This resumption was announced by the National Council for Solving Controversies (CNSC), which informed both the National Company for Road Infrastructure Administration (CNAIR) and the contesting company WUBUILD SpA (represented by lawyer Alexandra Dan) about the lifting of the suspension.
It is important to note that on September 27, the CNSC decided to suspend the auction until the contestation was resolved, and the final decision was communicated on October 4 and sent on October 7 to CNAIR and WUBUILD SpA (through lawyer Mona Maria Soltan).
The lifting of the suspension for Lot 1 coincided with the scheduled date for the auction of Lot 2 of the Suceava-Pașcani section of the A7 highway. However, in this case, the CNSC also ordered a suspension while another contestation was being resolved, filed by the same Italian company, WEBUILD SpA.
Thus, ten days after the CNSC’s decision partially accepting WUBUILD’s contestation, the suspension of Lot 1 was lifted. The Italian company had requested a 90-day extension to make some corrections following CNAIR’s responses to requests for clarification of the documentation. However, the Council concluded that “the modifications/completions made by the contracting authority do not warrant an extension beyond the initial deadline established in the award documentation for preparing the offer, considering the novelty of the provided information.”
The Council assessed that an additional 30 days were necessary, based on clarification number 1. Furthermore, the Council noted that the deadline for submitting offers had been extended by 16 days from the date when clarification set number 1 was sent. Therefore, the Council decided that the required period should be at least half of the time allocated for preparing the offers. This would mean 25 days, but the condition set by panel 11 of the CNSC was that this period would commence from the date when “the suspension of the procedure ends.”
If no additional elements intervene, the deadline for submitting offers for Lot 1 of the Suceava-Pașcani section of the A7 will be November 4.
Additionally, we mention that for Lot 2 of the Suceava-Pașcani section of the A7, where suspension was also decided until the contestation is resolved, the company WEBUILD requested an extension of 60 days for the submission deadline, not 90 days. The resolution of the contestation filed with the CNSC on October 8 for Lot 2 may take until the end of the month, and another panel of the Council will rule on this matter.
